These Terms & Conditions apply to purchases made through the American Protective Products website at app-ppe.com and to your use of this website.
American Protective Products LLC (“APP,” “we,” “us,” or “our”) supplies personal protective equipment, laboratory supplies, safety products, and related products to businesses, facilities, manufacturers, organizations, and other customers.
General Ordering & Fulfillment Policies
- Order Acceptance: Submission of an online order does not by itself create a contract between you and APP. All online orders are subject to acceptance by American Protective Products.
- Order Changes or Cancellation: APP reserves the right to decline, limit, or cancel an order when necessary, including in cases involving product availability, pricing or product information errors, suspected fraud, or other circumstances that prevent APP from fulfilling the order as submitted.
- Product Selection and Appropriate Use: Customers are responsible for determining whether a product is appropriate for their intended use, work environment, identified hazards, applicable workplace requirements, and required level of protection. Product information provided by APP is intended to assist customers in making purchasing decisions but should not replace an employer’s or purchaser’s responsibility to evaluate the requirements of a specific application.
- Commercial and B2B Accounts: APP works with businesses and organizations that may purchase products through quotes, purchase orders, recurring supply arrangements, negotiated pricing, credit terms, or other commercial agreements. These arrangements may include additional or different terms. Where written terms associated with a specific quote, purchase order, account, or supply agreement conflict with these website Terms & Conditions, the terms specific to that transaction or account will govern.
- Governing Law: These Terms & Conditions and online purchases through this website are governed by the laws of the State of Connecticut, subject to any applicable federal or other laws.
Pricing & Availability
Product prices and availability are subject to change without notice.
APP makes reasonable efforts to provide accurate product descriptions, pricing, availability, and other information on its website. However, errors may occasionally occur.
If a product is listed at an incorrect price or contains incorrect information because of a typographical, technical, inventory, or other error, APP reserves the right to refuse or cancel an affected order.
If payment has already been processed for an order that APP subsequently cancels because of such an error, APP will issue a refund or credit for the amount charged for the affected item or order.
Availability displayed on the website does not guarantee that a product will remain available through the time an order is accepted and fulfilled.
Payment
Online orders may be paid using the payment methods offered during checkout.
Customers are responsible for providing complete and accurate billing and payment information. Payment authorization or completion of checkout does not constitute APP’s acceptance of an order.
Approved commercial customers may also be eligible for invoicing, credit terms, or other payment arrangements established directly with APP. Any such arrangements are subject to the terms approved for that specific account.
Applicable taxes, shipping charges, freight costs, and other charges will be added where required.
Shipping & Delivery
APP primarily ships parcel orders through FedEx, although another carrier or shipping method may be used when appropriate based on product type, order size, destination, availability, or other fulfillment requirements.
Shipping and delivery charges may be calculated during checkout or quoted separately for orders requiring special handling, freight shipment, or other delivery arrangements.
Any delivery date or transit time provided by APP is an estimate unless APP has specifically agreed otherwise in writing. Carrier delays, weather conditions, supply disruptions, transportation issues, and other circumstances outside APP’s reasonable control may affect delivery times.
Customers are responsible for providing a complete and accurate shipping address. Additional shipping or handling charges resulting from an incorrect or incomplete address may be the responsibility of the customer.
When tracking information is available, APP may provide it to the customer after an order has shipped.
Lost or Carrier-Damaged Shipments
If an order is lost in transit or arrives damaged as a result of shipping, contact American Protective Products as soon as possible. Please retain the product, packaging, shipping label, and any other materials that may be needed to document the condition of the shipment.
APP will work with the customer and the applicable carrier to review the shipment and determine the appropriate next steps, which may include replacement, credit, return, or a carrier claim depending on the circumstances.
Products Shipped in Error by APP
Customers must notify APP of shipping errors or disputes within three (3) business days of receipt.
Products shipped in error by APP are freely returnable for full credit or exchange provided the return or exchange is made within thirty (30) days of receipt.
Defective or damaged products properly noted, and returns that are the result of an APP error, may be returned at APP’s expense for full credit subject to the return guidelines below.
Returns
All returns require prior authorization from American Protective Products.
Defective products are returnable with prior authorization. Non-defective products may also be returned provided the customer obtains prior authorization from APP and the products otherwise meet the requirements of this policy.
Restocking Fee
For approved non-defective returns made within 30 days:
30% Restocking Fee based on the invoice total, plus any applicable freight charges, with a $25 minimum restocking fee.
Products returned more than 30 days after purchase are not returnable unless the return has been expressly approved in advance by an APP Sales Representative or APP Management.
Non-Returnable Products
The following products are not eligible for return unless expressly approved by APP:
- Products purchased more than 30 days prior to the return request.
- Products considered hazardous materials.
- Special or custom orders made specifically to customer requirements.
- Products returned in altered or damaged packaging, or in packaging other than the original packaging.
- Packs that have been broken, breached, or damaged.
- Items in unsellable units of measure where the product cannot reasonably be resold.
- Products with less than three months of shelf life remaining based on expiration dates.
- Third-party vendor products that require vendor return authorization. These returns are subject to the applicable vendor’s return policy and fees.
APP reserves the right to inspect returned products before issuing a credit or refund.
Shipping and freight charges associated with an approved non-defective return are the responsibility of the customer unless otherwise agreed by APP.
Product Information & Manufacturer Specifications
APP distributes products from multiple manufacturers in addition to products supplied under APP brands or specifications.
Product descriptions, specifications, certifications, materials, dimensions, performance information, country of origin, expiration information, and other product details may be supplied directly by APP or by third-party manufacturers.
APP makes reasonable efforts to keep this information accurate and current; however, manufacturers may modify products, packaging, specifications, or sourcing without prior notice.
APP may offer products with different manufacturing origins, including imported products and products identified as Made in the USA.
If your organization requires a particular country of origin, certification, standard, material, specification, compatibility, shelf life, or other product characteristics, please confirm those requirements with APP before placing your order.
Product photographs and images are intended to represent the products offered but minor differences in packaging, labeling, appearance, or other non-material characteristics may occur.
Website Use & Intellectual Property
The content of the APP website, including text, graphics, photographs, logos, product information, page designs, and other original materials, is owned by or licensed to American Protective Products unless otherwise indicated.
Website content may be viewed and used for legitimate purchasing, product evaluation, and business purposes. Content may not be reproduced, republished, distributed, or commercially exploited without authorization from APP or the applicable rights holder.
Product names, trademarks, logos, and other materials belonging to third-party manufacturers remain the property of their respective owners.
Website and Product Information Disclaimer
APP works to maintain accurate and useful information throughout its website. However, website content may occasionally contain errors, omissions, outdated information, or information supplied by third-party manufacturers.
Website content is provided for general informational and purchasing purposes and should not be interpreted as professional safety, medical, regulatory, engineering, or compliance advice.
Customers remain responsible for evaluating whether the products they purchase are appropriate for their organization and intended use.
To the extent permitted by applicable law, APP will not be responsible for indirect, incidental, special, or consequential damages arising solely from use of the website or reliance on website content.
Nothing in these Terms & Conditions is intended to limit rights or remedies that cannot legally be limited under applicable law.
Third-Party Websites
The APP website may contain links to websites operated by manufacturers, service providers, carriers, or other third parties.
APP is not responsible for the content, privacy practices, availability, or policies of third-party websites. Use of those websites is subject to the terms and policies established by the applicable third party.
Privacy
Information collected through the APP website is handled in accordance with our Privacy Policy.
The Privacy Policy explains how APP collects, uses, and protects information provided by website visitors and customers.
Changes to These Terms
APP may update these Terms & Conditions periodically to reflect changes in our website, products, ordering practices, fulfillment policies, or other business requirements.
The most current version will be posted on this page along with the date it was last updated.
Changes apply prospectively unless otherwise required by law or expressly agreed in connection with an existing customer account or commercial agreement.
